NORTH MIAMI RELIEF EFFORTS FOR HAITI'S EARTHQUAKE VICTIMS

The city of North Miami is partnering with Miami-Dade County and the National Haitian-American Elected Officials Network (NHAEON) and other government and non-profit agencies on relief efforts for Haiti in the aftermath of the January 12th earthquake.

The United States government has determined that an 18-month designate of Temporary Protected Status (TPS) for Haiti is warranted as a result of the devastating earthquake.  The application process for Haitian nationals seeking TPS started begins January 21, 2010.

FREE HELP FOR HAITIAN NATIONALS SEEKING TPS STATUS IN U.S.
Assistance with Application Process Offered in North Miami on Saturday

Due to the success of our previous Temporary Protected Status Application Drive held on January 30th, North Miami Mayor Andre D. Pierre, the North Miami Community Redevelopment Agency (CRA) and The Haitian Lawyers Association, Inc. will host a second drive for qualifying Haitian Nationals. Over two hundred applications were processed at the first drive and more participants are expected to follow this weekend.  The TPS Application Drive will be held on Saturday, February 13, 2010, from 10 a.m. to 4 p.m. at the Griffing Adult Center, 12220 Griffing Boulevard, in North Miami.  

Haitian Lawyers Association members and volunteers will be available to help eligible Haitian Nationals seeking TPS to complete the required applications.  To be granted TPS, the following requirements must be met:

  • Be a national of Haiti
  • Arrived into the United States on or before January 12, 2010
  • Have continuously resided in the U.S. since arrival
  • Have not been convicted of any felony or two or more misdemeanors in the United States

To receive on-site assistance, individuals must bring the required documents, including:

  • Birth Certificate, Passport, or Baptismal Certificate
  • Two Color Passport Style Photos
  • Social Security card (if any)
  • Driver License (if any)
  • I-94 (if any)
  • Work permit (if any, even if expired)
  • If you have ever been arrested anywhere in the United States, please bring certified arrest records
  • Bring as many as you can of Continuous Physical Presence that you have been living in the US since January 12, 2010, examples:
    • Lease or rental agreement
    • Bank statements
    • Telephone, cable or electrical bills
    • Medical receipts
    • Taxes
    • Employment records, reflecting dates of employment
    • Affidavit from employer (must be notarized)
    • Affidavit from your Church stating the dates of membership
    • For children: school records, medical records

Temporary Protected Status (TPS) Update as Thursday, February 4, 2010

Overview
  • Approximately 6,000 applications have been received and approximately 5,000 have been processed by U.S. Citizenship and Immigration Services
  • A denial of political asylum does not automatically affect TPS
  • Denial of TPS, depending on the circumstances, may activate other legal proceedings
Incomplete Forms
  • The rejection rate has increased to 7% due to the following errors:
    - Unsigned forms
    - Biographical data missing
    - Incorrect processing fees
  • Under the I-765 Application for Employment Authorization it is important to state only one reason
Fee Waiver
  • Fee waiver requests must include the following:
    - A signed and dated affidavit, "I declare under penalty of perjury that the aforementioned is correct..."
    - Evidence of income/expenses/asset
    - Evidence that the applicant is receiving state benefit(s)
  • If the applicant has a previous application number, the number should be included
  • Allow two weeks for fee waiver determination
  • If an applicant sends payment and a fee waiver is approved, the applicant will receive a reimbursement  
Proof of  Nationalization   
  • Documents of nationality are primary documents; however, copies of birth certificates are acceptable
  • Birth certificate and/or parental passport
    *If child is not included in parental passport copies, whatever goes in the parents' application should be included in the child's application
    *Continuous residence is not interrupted by a brief/casual interruption
